Employer of record in the Philippines
Employing someone in the Philippines through an employer of record: SSS, PhilHealth and Pag-IBIG on top of salary, the Metro Manila minimum wage, probation, notice and separation pay, and why employment isn't at will.
Checked on 16 October 2026. The headline rules for a standard employee, from official sources where they opened and law firm, PwC or specialist publisher guides where they didn't; each line names its source. Sectors, collective agreements and contracts can change them. This is general information, not legal advice.
Know this first
- Employment isn't at will: a dismissal needs a cause the Labor Code recognises, and due process.
- Minimum wages change by regional wage order, sometimes mid-year. An earlier Metro Manila order (NCR-27) was stopped by the courts and is still in legal proceedings.
- Working hours, the written contract and pay frequency rules, and the 13th-month formula, are left out here because the official sources didn't open for us.

Employing someone in the Philippines
- Employer costs on top of salary
- About 14.5% of pay, but each part has its own cap: SSS 10% (on pay up to ₱35,000 a month, plus a small injury cover), PhilHealth 2.5% (on pay up to ₱100,000) and Pag-IBIG 2% (up to ₱200 a month). Above ₱100,000 a month it comes to about ₱6,230 a month (our sum). These are the 2025 rates; we found no 2026 change, but couldn't confirm them on an official page. - Minimum wage
- Set by region. Metro Manila: ₱755 a day for non-agricultural work from 26 September 2026 (₱718 for agriculture, retail and service businesses with 15 or fewer workers, and manufacturers with fewer than 10). GMA News, the NCR wage order, September 2026, Lockton Philippines, September 2026
- Holiday
- 5 days' paid service incentive leave a year after a year's service (it also covers sickness), except in workplaces with fewer than 10 staff or where 5 or more days' paid leave is already given, according to a legal guide. 10 regular holidays and 8 special non-working days in 2026, plus the Eid holidays. Batas Natin, service incentive leave, PTV News, the 2026 holidays
- Probation
- Up to 6 months. The standards for becoming permanent must be explained at the start; anyone kept on after probation becomes a regular employee. NDV Law, June 2026
- Notice from the employer
- For redundancy, retrenchment or closure: at least a month's written notice to the employee and to the labour department. For misconduct: no notice period, but a two-notice procedure, with at least 5 days to respond. Supreme Court, PNCC Skyway v. Secretary of Labor, Chambers, Employment 2025: Philippines
- Severance
- For retrenchment, or closure not caused by serious losses: one month's pay or half a month per year of service, whichever is more. Redundancy pay wasn't in the sources we could read, so check the amount with your provider. Supreme Court, PNCC Skyway v. Secretary of Labor, Chambers, Employment 2025: Philippines
- Extra pay the law requires
- 13th-month pay is required by law. We couldn't open an official source for its amount and deadline, so ask your provider.
- Payroll and tax
- The employer withholds income tax: none up to ₱250,000 a year, then 15% to 35%. Department of Finance, the TRAIN law
