Employer of record in Poland
Employing someone in Poland through an employer of record: social security on top of salary, the workplace pension, the minimum wage, leave, notice and severance, and the language rule for contracts.
Checked on 16 October 2026. The headline rules for a standard employee, from official sources where they opened and law firm, PwC or specialist publisher guides where they didn't; each line names its source. Sectors, collective agreements and contracts can change them. This is general information, not legal advice.
Know this first
- Leave, hours, probation and notice are from the labour inspectorate's 2023 guide; the 2026 Labour Code text didn't open for us, so check for later changes.
- The workplace pension and sick pay rows rest on a commercial guide, because the official ZUS pages didn't open for us.
Employing someone in Poland
- Employer costs on top of salary
- About 19.5% to 22.1% (our sum), depending on the accident rate: pension and disability 16.26%, accident insurance 0.67% to 3.33% by sector (1.67% for up to 9 employees), Labour Fund 2.45% and the wage guarantee fund 0.10%. Pension and disability stop at PLN 282,600 a year in 2026. PwC gives 19.21% to 22.41%, which doesn't quite add up from its own rates. A commercial guide reports that the employer also pays 1.5% into the PPK workplace pension unless the employee opts out. PwC Worldwide Tax Summaries, Poland, August 2026, Poradnik Przedsiębiorcy, PPK
- Minimum wage
- PLN 4,806 a month, or PLN 31.40 an hour, from 1 January 2026. Zielona Linia (state employment service), December 2025
- Holiday
- 20 days a year, or 26 after 10 years of employment. 14 public holidays, plus every Sunday. PIP (National Labour Inspectorate), labour law first steps, 2023, Infor.pl, public holidays
- Working hours
- 8 hours a day and 40 a week on average. PIP (National Labour Inspectorate), labour law first steps, 2023
- Probation
- A trial contract of up to 3 months. PIP (National Labour Inspectorate), labour law first steps, 2023
- Notice from the employer
- 2 weeks under 6 months' service, 1 month up to 3 years, then 3 months. PIP (National Labour Inspectorate), labour law first steps, 2023
- Severance
- Only for employers with 20 or more employees, when the reason isn't the employee: 1 month's pay under 2 years' service, 2 months up to 8 years, 3 months after that, up to 15 times the minimum wage. Zielona Linia, severance pay
- Extra pay the law requires
- None found apart from the PPK pension above.
- Contract
- In writing, or confirmed in writing before work starts. In Polish by default; a contract only in another language is allowed at the request of a foreign worker who knows it, and since 2025 the employer then needs a sworn Polish translation. PIP (National Labour Inspectorate), labour law first steps, 2023, Prawo.pl (Wolters Kluwer), June 2025
- Payroll and tax
- Paid at least monthly, by the 10th of the next month. The employer withholds income tax advances. PIP (National Labour Inspectorate), labour law first steps, 2023, PwC Worldwide Tax Summaries, Poland, tax administration
- Sick pay
- Paid by the employer, at least 80% of pay, for up to 33 days a year (14 from the year after the employee turns 50); then from social security. Poradnik Przedsiębiorcy, sick pay, May 2026
