Employer of record in Belgium

Employing someone in Belgium through an employer of record: employer social security, the minimum wage, 20 days' leave and double holiday pay, the 13th month under joint committees, notice in weeks, and the 2026 notice reforms.

Checked on 16 October 2026. The headline rules for a standard employee, from official sources where they opened and law firm, PwC or specialist publisher guides where they didn't; each line names its source. Sectors, collective agreements and contracts can change them. This is general information, not legal advice.

Know this first

  1. Dismissal isn't at will: staff can ask for the reasons, and a manifestly unreasonable dismissal costs compensation (except in the first 6 months for contracts from 1 August 2026).
  2. Every employer falls under a joint committee whose agreements set pay scales and bonuses; ask your provider which one applies.
  3. Most figures here come from payroll firms, law firms and unions, because the social security office's pages didn't open for us.

Employing someone in Belgium

Employer costs on top of salary
A basic 25% for office staff, or about 27% with sector and other contributions, according to PwC. Since 1 July 2025 the basic contribution stops on quarterly pay above a threshold, set at €85,000 and indexed to €88,434 from July 2026 according to a payroll firm. The employee pays 13.07%, with no cap. Securex, basic employer contributions, July 2026, LexGO, October 2025, PwC Worldwide Tax Summaries, Belgium, September 2026
Minimum wage
€2,189.81 a month for full-time adults from 1 April 2026, rising to €2,233.61 after indexation in July 2026, according to a payroll firm. A joint committee's higher minimum applies where there is one. Securex, March 2026, Securex, current amounts, July 2026
Holiday
20 days on a 5-day week, based on time worked the year before. Office staff also get double holiday pay of 92% of a month's salary. 10 public holidays; one that falls on a day off must be replaced with another day. CSC (trade union), July 2025, Deg & Partners, October 2025
Working hours
38 hours a week is the usual reference, normally 8 hours a day. Partena Professional, hiring full time
Probation
No probation clause since 2014. But for contracts starting from 1 August 2026, either side can end the job with one week's notice in the first 6 months. LexGO, new notice rules, August 2026, Grant Thornton Belgium, June 2026
Notice from the employer
Set in weeks by length of service: 1 week in the first 3 months, 12 weeks at 2 years, 13 at 3, 15 at 4, 18 at 5 years, then 3 more a year up to 62 weeks at 20 years, then 1 more a year (67 at 25 years). For contracts from 1 June 2026, it's capped at 52 weeks. Securex, notice periods, Grant Thornton Belgium, June 2026
Severance
No separate redundancy payment: the cost is the notice period or pay in lieu. Where notice is 30 weeks or more, part of it goes on training or outplacement, which the employer must offer. Securex, outplacement, L&E Global, June 2024
Extra pay the law requires
Double holiday pay (above). A 13th month isn't set by national law, but sector agreements require one: under joint committee 200, the default for many office staff, it's a full month's pay after 6 months' service. ACCG (trade union), CP 200 year-end bonus
Contract
The language depends on the region where the employer operates: in Flanders, employment documents must be in Dutch (our source is from 2012; a 2013 EU court ruling led Flanders to allow a translation alongside for cross-border cases). The rules for Wallonia, Brussels and the German-speaking area weren't confirmed in our sources. LexGO, contract language, 2012
Payroll and tax
Office staff can be paid monthly; manual workers at least twice a month. The employer withholds income tax and the employee's 13.07%. The job must be declared to social security (DIMONA) by the time work starts. FPS Employment, pay dates, PwC Worldwide Tax Summaries, Belgium, September 2026, Boundless, payroll in Belgium, September 2026, Securex, DIMONA, February 2026
Sick pay
Paid by the employer for the first 30 days for office staff with at least a month's service, at full pay for the first week, then the health insurance fund takes over. From 2026, employers with more than 50 staff also pay 30% of the benefit in months 2 and 3. Securex, guaranteed salary, January 2026, Securex, solidarity contribution, 2026

Where this comes from. Government, social security and labour ministry pages, the laws themselves, PwC Worldwide Tax Summaries, law firm briefings and specialist publishers, each named next to what it supports, and each provider's own website for what it covers. All read on 16 October 2026. Totals marked "our sum" are our addition of the source's rates.

This is not legal or tax advice. Rules change, and sectors and collective agreements add their own. Ask your provider, or a local adviser, for the rules that apply to your hire.

How we make money from this page. Some links may earn us a commission, and they are marked "Affiliate link" where they do. The providers appear in order of published starting price, which doesn't depend on that.
